Welcome to Fōgy Drone Services ("Company," "we," "us," or "our"). These Terms and Conditions govern your use of our website located at www.fogydroneservices.com (the "Site") and apply to all visitors, clients, and other users who access or use the Site.

By accessing or using the Site, you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, then you may not access the Site.

1. Services Offered

The Site provides information regarding our professional Unmanned Aircraft System (UAS) services, including aerial photography, cinematic video production, construction progress monitoring, inspections.

  • Service Contract Required: All actual drone services are subject to a separate, written Service Agreement or Contract which will detail the scope of work, pricing, timelines, payment terms, required permissions, and specific liability clauses. The terms on this Site do not supersede a signed Service Contract.

2. Intellectual Property and Licensing

A. Ownership of Website Content

The Site, its original content, features, and functionality (including text, graphics, logos, and service marks) are and will remain the exclusive property of Fōgy Drone Services.

B. Ownership of Client Deliverables (Drone Footage)

  1. Ownership: Upon full payment of the final invoice for any service, ownership of the completed aerial photos, videos, or data (the "Deliverables") shall pass to the Client.

Company Portfolio License: Notwithstanding the transfer of ownership, the Client grants Fōgy Drone Services a perpetual, non-exclusive, worldwide, royalty-free license to use a reasonable number of the Deliverables for the sole purpose of marketing and promoting our services (e.g., on our website, social media, and marketing materials), unless otherwise agreed upon in the separate Service Contract.

3. User Obligations and Prohibited Uses

You agree not to use the Site:

  • In any way that violates any applicable local, state, national, or international law or regulation.

  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.

  • To impersonate or attempt to impersonate the Company, a Company employee, or another user.

  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm the Company or users of the Site.

4. Safety, Compliance, and Liability Disclaimer

A. Regulatory Compliance

All commercial flight operations conducted by Fōgy Drone Services will be performed by a pilot holding the necessary certification (e.g., FAA Part 107 in the US) and in compliance with all relevant aviation laws and regulations (e.g., airspace authorizations, flight rules, liability insurance).

B. Flight Cancellation and Force Majeure

  • Weather/Safety: We reserve the right to cancel or reschedule any flight operation at any time if, in the pilot's professional judgment, conditions (including wind, rain, low visibility, equipment failure, or safety concerns) make the flight unsafe or non-compliant with regulations.

  • Force Majeure: We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control, including severe weather events, temporary Flight Restrictions (TFRs), or government action.

C. Limitation of Liability

The use of this website is at your own risk. To the maximum extent permitted by applicable law, in no event shall Fōgy Drone Services nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Site;

  • Any conduct or content of any third party on the Site; or

  • Any unauthorized access, use, or alteration of your transmissions or content.

5. Indemnification

You agree to defend, indemnify, and hold harmless Fōgy Drone Services and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), which result from or arise out of a) your use and access of the Site, or b) a breach of these Terms.

6. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located within Pima County, Tucson, Arizona] for the resolution of any disputes.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms.
